EASY FOREX-KUNDENVEREINBARUNG - Allgemeine Geschäftsbedingungen Diese Kundenvereinbarung wird in ihrer jeweils gültigen Fassung vom 28. Juli 2016 wirksam. 1. Geltungsbereich dieses Abkommens 1.1 Dieses Abkommen bestimmt das Vertragsverhältnis zwischen der Gesellschaft (uns) und dem Kunden (Sie). Sie sollten die Vereinbarung sorgfältig lesen, verstehen und mit den Bedingungen einverstanden sein, bevor Sie ein Vertragsverhältnis mit uns schließen. 2.1 Verweise auf den Begriff der Gesellschaft in dieser Vereinbarung beziehen sich auf Easy Forex Trading Ltd. 2.2 Die Gesellschaft ist in Zypern mit ihrer eingetragenen Adresse in Griva Digeni 1 Ave, Kriel Court, Office 303, 3035 Limassol, Cyprus - CySec Lizenznummer 079 eingetragen / 07. 3.1 Das Unternehmen ist eine Pionier-Online-Handelsgruppe, die 2003 gegründet wurde und seitdem Währungen, Rohstoffe, Indizes und Optionshandel in über 160 Ländern revolutioniert hat. ORE Platform (Eigentumsrechte der ORE Technologies Ltd) 3.4 Wir bieten Ihnen außerdem folgende Dienstleistungen an: Direct Phone Umgang mit unseren professionellen Vertriebspartnern Umgang mit dem Unternehmen Chat Service 4. Betrieb eines Handelskontos 4.1 Eröffnung eines Live Trading Accounts (Active Account) Um Handelsgeschäfte abschließen zu können, müssen Sie zunächst ein aktives Konto eröffnen. Es gibt verschiedene Arten von Konten können Sie wählen, um zu betreiben. Sie können Ihr Konto ändern oder aktualisieren, um es Ihren Anforderungen anzupassen, oder Sie können mit einem unserer professionellen Client-Manager sprechen. Jedoch darf jeder Kunde nur ein aktives Handelskonto bei uns betreiben. I Wenn ein Kunde mehr als ein Active-Konto bei uns eröffnet, behält sich das Unternehmen das Recht vor, die zusätzlichen Konten und alle damit verbundenen offenen Handelspositionen zu schließen. Ii 4.2 KYC-Dokumentation (Documentation / Client Identification Procedure) 4.2.1 Sie erklären sich damit einverstanden, während des Registrierungsprozesses echte, aktuelle und vollständige Informationen über sich selbst zur Verfügung zu stellen. Wenn Sie ein Bevollmächtigter eines Unternehmens sind, erklären Sie, dass Sie berechtigt sind, die Gesellschaft an diese Vereinbarung zu binden. Wir sind gesetzlich verpflichtet, Informationen zu erhalten, zu überprüfen und aufzuzeichnen, die jede Person identifizieren, die ein Konto eröffnet. Wenn Sie ein Konto eröffnen, bitten wir Sie daher, bestimmte Unterlagen vorzulegen, um sich zu identifizieren und die bei der Registrierung übermittelten Informationen zu überprüfen. 4.2.2 Kundennachweis: Sie müssen uns folgende Ausweisdokumente zusenden: ID-ID. Eine klare Kopie Ihres Führerscheins, Ihres Personalausweises oder Ihres internationalen Reisepasses. Plus Nachweis der Adresse. Eine klare Kopie einer neuen Versorgungsrechnung, eines Kontoauszugs oder einer anderen Kommunalrechnung. Der Nachweis Ihrer Anschrift muss Ihren vollständigen Namen und Ihre Adresse enthalten und innerhalb der letzten 6 Monate ausgestellt worden sein. Die Erhebung und Genehmigung der Dokumente muss innerhalb von 15 (15) Tagen abgeschlossen sein. Wenn Ihre Identifikationsdokumente nicht innerhalb von 15 Tagen nach Eröffnung Ihres Kontos genehmigt werden, schließen wir Ihr Konto und Sie werden nicht mehr in der Lage sein zu handeln oder einzahlen. Alle offenen oder ausstehenden Positionen werden zum aktuellen Kurs um 21:00 Uhr GMT am fünfzehnten (15.) Tag nach Kontoeröffnung geschlossen (siehe Geschäftsbedingungen). Alle Gutschriften und / oder Boni werden aus Ihrem Trading-Konto entfernt. Alle Gewinne werden Ihnen per Banküberweisung zugesandt und wir benötigen die oben genannten Dokumente, um die Transaktion abzuschließen (siehe Abschnitt 4.2.2 (a) oben). Etwaige Verluste werden von den Rücklagen (Einlagen) abgezogen. Zustimmung - Mit der Annahme dieser Geschäftsbedingungen erklären Sie sich hiermit ausdrücklich einverstanden. 4.2.3 Wir behalten uns das Recht vor, eine Registrierung nach eigenem Ermessen zu verweigern oder abzulehnen oder auf der Grundlage gesetzlicher Auflagen. 4.3 Active-Account-Sicherheit und - Management Sobald Sie ein Konto bei uns eröffnen, müssen Sie einen Benutzernamen und ein Passwort festlegen, das Sie bei jeder Nutzung unserer Dienste verwenden können. Bitte ergreifen Sie alle erforderlichen Maßnahmen, um diese Informationen außerhalb der Öffentlichkeit zu halten und nicht mit anderen zu teilen. Sie sind dafür verantwortlich, diese Informationen zu schützen. Wenn Sie irgendwelche der oben genannten Daten verlegen oder verlieren oder Sie vermuten, dass jemand anderes Zugriff darauf hat, sollten Sie uns dies unverzüglich schriftlich mitteilen. 4.4 Segregated Accounts Wir sind ein Finanzdienstleistungsunternehmen mit transparenten Prozessen in allen unseren Beziehungen zu Ihnen. Alle Gelder, die wir von Ihnen erhalten, werden als Kundengelder behandelt, und sie werden in separaten Kundenbankkonten (getrennte Konten) in einem renommierten Bankinstitut unserer Auswahl geführt. Wir sind gesetzlich verpflichtet, regelmäßige Überprüfungen und Kontrollen durchzuführen, wie diese Konten von einem Bankinstitut verwaltet und betrieben werden. 4.5 Währung Alle Beträge für die Eröffnung und den Betrieb Ihres Kontos sind in der Währung zahlbar, die Sie bei der Eröffnung Ihres Kontos bei uns gewählt haben. 4.6 Zahlungsmethoden Wir akzeptieren nur freigegebene Mittel (Mittel, die in Ihrem Bank - / Debit - / Kreditkartenkonto verfügbar sind). Ein Rücktritt auf ein Bankkonto, bei dem Einlagen mit Debit - oder Kreditkarten oder E-Brieftaschen erfolgen, erfolgt nach unserem Ermessen. 4.7.3 Abhebungen: Bei Abhebungen auf Bankkonten kann es länger dauern, bis Ihr Konto gutgeschrieben wird. Bei der Auswahl einer Konto-Basiswährung, abgesehen von der Währung, die in Ihrer Debit - oder Kreditkarte verwendet wird, können Gebühren entstehen, die aufgrund von Währungsumrechnungen oder sonstigen Gebühren entstehen. Daher kann Ihr erstatteter Betrag leicht von der Summe abweichen, die Sie ursprünglich in Ihrem Konto gespeichert haben Währung. Bitte lesen Sie die Bedingungen und Konditionen der Bank, die Sie über ein Konto in Bezug auf ihre Gebührenpolitik in Währungsumrechnung. 4.7.4 Überweisungen: Bei der Überweisung von Geldern per Banküberweisung müssen Sie Ihr Bankkonto bei einer Bank verwenden, die im Land Ihres ständigen Wohnsitzes ansässig ist. Dies ist eine absolute Anforderung, die durch die Rechtsvorschriften zur Bekämpfung der Geldwäsche auferlegt wird. Eine authentische SWIFT oder Überweisungsbestätigung, die den Ursprung der Gelder angibt, muss von unserer Bank an uns übermittelt werden. Wenn diese SWIFT - oder Übertragungsbestätigung nicht gesendet wird, kann die Kaution Ihr Konto nicht erreichen und es wird auf Ihr Bankkonto zurückgegeben. Wie bereits erwähnt, kann jede Rücknahme von Geldern aus Ihrem Konto nur auf das gleiche Bankkonto zurückerstattet werden, das die Gelder ursprünglich erhalten haben. 4.7.5 E-Brieftaschen Zahlungsmethoden: Wenn Sie beschließen, Gelder über E-Briefträger einzahlen, sind Sie an die Regeln und Bestimmungen dieses Dienstleisters gebunden. Sie können auch weiteren Gebühren und sonstigen Beschränkungen unterliegen. Bitte lesen Sie die Nutzungsbedingungen Ihres Dienstanbieters für weitere Informationen. Wir werden Ihr Konto mit dem Nettobetrag, den wir erhalten haben, gutgeschrieben. Bitte beachten Sie, dass wir Abhebungen über eine andere Einrichtung als den für die ursprüngliche Einzahlung eingesetzten Anbieter durchführen müssen, wenn dies für rechtliche und regulatorische Zwecke erforderlich ist (Geldwäschevorschriften). 4.7.6 Einzahlungsbeschränkungen: Bitte beachten Sie auch, dass wir nach eigenem Ermessen gewisse Einschränkungen für die Beträge vornehmen können, die Sie mit Ihrer Debit - oder Kreditkarte hinterlegt haben. 4.8 Rollentgelte Sie können eine Tagesgeschäftsposition bis zum darauffolgenden Tag verlängern. Diese Verlängerung unterliegt einer Erneuerungsgebühr (Rolling Fee) zu einem Satz und Zeit, auf unserer Website angegeben. Wir sammeln die Rolling Fee automatisch aus dem freien Kontostand in Ihrem Konto. Wenn es nicht genügend Geld in Ihrem freien Gleichgewicht gibt, können wir die Rollgebühr direkt von Ihrer Kreditkarte abziehen (indikative Mindestbelastung 3,00 USD). Wenn Sie eine andere Zahlungsmethode verwenden und wir nicht in der Lage sind, die Rollgebühr zu erheben, können wir einige oder alle offenen Positionen schließen. 4.9 Islamische Konten 4.9.1 Im Falle eines Kunden, der aufgrund der Einhaltung islamischer Glaubensbekenntnisse keine Zinsen erhalten oder bezahlen kann, kann der Kunde wählen, dass sein Handelskonto tauschfrei ist Konto nicht mit Rollovers und / oder Zinsen (islamisches Konto) belastet oder berechtigt sind. Der Kunde bestätigt und akzeptiert, dass ein Antrag auf Erbringung seiner Rechnung als islamisch nur aufgrund der islamischen religiösen Überzeugungen und aus keinem anderen Grund gemacht werden kann. Die Gesellschaft behält sich das Recht vor, den Antrag eines Kunden zu verweigern, sein Konto als ein islamisches Konto zu bezeichnen. 4.9.2 Für den Fall, dass die Gesellschaft vermutet, dass ein Kunde die Rechte, die ihm durch die Einstufung des Kontos als islamisches Konto eingeräumt werden, missbraucht, hat die Gesellschaft das Recht, Folgendes: Erinnern Sie sich an die Benennung des Kontos als islamisches Konto und machen Sie es zu einem normalen Handelskonto und / oder Schließen Sie alle offenen Positionen und setzen Sie sie auf den dann realen Marktpreis wieder ein. Der Kunde erkennt hiermit an, dass er alle Kosten trägt, die aus der vorgenannten Maßnahme entstanden sind, einschließlich, aber nicht beschränkt auf die Kosten für die Änderung des Spread. 4.10 Traderkonten Archivierung (MetTrader 4 Plattform (MT4) Benutzer NUR) 4.10.1 Jeden Sonntag führen wir automatische Archivierung zu MT4 Konten durch, die ALLE der folgenden Bedingungen erfüllen: Zeit der Kontoinaktivität (Zeit seit dem letzten Zugriff auf das MT4-Konto (Login )) Übersteigt 180 aufeinanderfolgende Tage und der Kontostand ist 0 UND es gibt keine offenen Positionen auf diesem Konto und keine Positionen wurden während der Inaktivität geschlossen (keine Handelstätigkeit auf dem Konto, wie Übertragung von Agenten Provisionen, hinterlegt Amp Auszahlungen). 4.10.2 Sie können Ihr MT4-Handelskonto jederzeit, nach der Archivierung, ohne Kosten oder Strafgebühr, durch Kontaktaufnahme mit uns neu aktivieren. 4.11 Dormant Accounts Kundenkonten, in denen keine Geschäfte für einen festgelegten Zeitraum von zwölf (12) aufeinander folgenden Monaten stattgefunden haben, werden als ruhender betrachtet. Ruhende Konten werden mit der Wartungsgebühr von US25 oder dem vollen Betrag des freien Kontos auf dem Konto belastet, wenn der freie Saldo weniger als US25 beträgt. Es gibt keine Gebühr, wenn die freie Balance Null ist. Konten mit einem Null-Saldo können ebenfalls geschlossen werden. Die dormant Konten Gebühr wird halbjährlich durchgeführt werden. 4.12 Erfüllungsort Die Gesellschaft ergreift alle zumutbaren Schritte und eine Reihe von Faktoren, um bestmögliche Ergebnisse für die Kunden der Gesellschaft zu erhalten, und zwar sowohl bei der Ausführung von Kundenaufträgen als auch bei der Erteilung und Übertragung von Aufträgen zur Ausführung in Bezug auf Finanzinstrumente. Unbefugte Tätigkeiten 7.1 Einleitung Es ist nicht gestattet, die Leistungen der Gesellschaft für eine nicht genehmigte Tätigkeit zu nutzen. Bei der Nutzung der Dienstleistungen der Gesellschaft erklären Sie sich damit einverstanden, dass Sie unsere Produkte und Dienstleistungen nicht für unautorisierte Aktivitäten verwenden. Nachfolgend sind die nicht autorisierten Aktivitäten beschrieben. Unbefugte Handlung bedeutet jede Handlung, einschließlich, aber nicht beschränkt auf: 7.2 Geldwäsche Die Verheimlichung der Ursprünge von illegal gekauftem Geld, in der Regel durch Geldtransfers mit ausländischen Banken oder legitimen Geschäften. Soweit diese Aktivität entdeckt wird, behält sich die Gesellschaft das Recht vor, die betroffenen Konten und alle damit verbundenen offenen Handelspositionen zu schließen. 7.11 Aktion Die Gesellschaft behält sich das Recht vor, die entsprechenden Maßnahmen in den Fällen zu treffen, in denen die Bedingungen dieser Vereinbarung verletzt worden sind. Die Folgen eines Verstoßes gegen eine oder mehrere der Bedingungen, die als nicht autorisierte Tätigkeiten gelten, könnten die Aussetzung oder Schließung von Geschäften, die Rückgabe von Geldern und / oder die Aussetzung oder Schließung Ihres Kontos bedeuten. 8. Geistiges Eigentum 8.1 Das gesamte geistige Eigentum unserer eigenen Plattformen, Produkte und Dienstleistungen gehört der Gesellschaft. Wir erlauben Ihnen nur den Zugang und die Nutzung der Plattformen für die Durchführung der Handelsgeschäfte. Intellectual Property umfasst unter anderem das Urheberrecht an Materialien, Plattformen, Software, Prozessen, Quellcode, Websites, Patenten, Entwürfen, Datenbanken, Patenten, Marken, Methoden, Know-how, Geschäftsgeheimnissen, Geschäftsplänen, Werbung und Marketing Material, in jeder Art von Form. Wir behalten uns alle Rechte, Eigentumsrechte und Interessen an allen unseren geistigen Eigentumsrechten aus diesem Vertrag vor. 9. Nicht-exklusive Lizenz zur Nutzung der Plattform 9.1 Wir gewähren Ihnen nur eine nicht exklusive und nicht übertragbare Lizenz für den Zugriff und die Nutzung unserer proprietären Plattformen oder Drittplattformen, die wir verwalten und von unseren Produkten und Dienstleistungen profitieren.
